Ben Gilroy Takes Back The Junction Bar from Receiver

Ben Gilroy and the owner of The Junction Bar in Glounthaune, Co Cork, decided it was time to take back the bar from the receivers who had moved in. In this TV3 report the owner politely informed the manager (in other words, the receiver) that he has been dismissed. The owner of course has the right to do this as the receiver acts as agent for both the owner of the premises, and the bank in question. As the owner or The Junction Bar did not contract the receiver to act as agent for them, the owner has no obligation for the receiver to do so.

Aside from this fact, the receiver has an equitable duty of care to both the bank, and the owner of The Junction Bar, and as they have not performed on this duty of care, the owner has opted to dismiss them. The topic is covered in more details in the video concerning Mr. Gerry Burns. In a true equitable duty of care, the receiver would need to see the tri-party agreement used to create the loan in question. It is a fair assessment to suggest that a receiver who would ask for such things from the bank (which they may not have) would not be called in as a receiver on behalf of the bank in the future. Due to this implied incentive not to ask, receivers tend not to perform as well on their duty of care to the owner of the property, as they might do for the bank that called them in the first place, rather than renegotiating the loan to see that it gets paid without need for litigation.

As ever Ben has advised the owner of The Junction Bar to give the banks nothing until they document and prove the obligation. Given the banks tendency towards securitization, they may find that challenge difficult if not impossible. Due to this, the bank may regret not just renegotiating the loan, and getting their money back more slowly and certainly surely.

Ben Gilroy Halts Eviction of an 80 Year Old Woman

Ben Gilroy, People For Economic Justice and the Anti-Eviction Taskforce arrived at the flat of an 80-year-old woman this morning at 10am. The 80-year-old woman in question had been informed prior to that morning that the Sheriff would arrive at 11am. Upon arrival Ben found that the Sheriff had already been there. He discovered a locksmith was fixing a new lock to the door, having drilled through the old one. It was evident by the debris left from the drill, that the old lock had been removed by force. Ben kindly asked the Locksmith what he was doing, and upon hearing the news, asked the Locksmith for the key’s and informed him that what the Sheriff was doing was unlawful. The Locksmith kindly obliged.

Ben and People For Economic Justice then educated the 80-year-old woman on her rights and began preparation for barricading the apartment against further intrusion. Upon arrival of the Gardai to remove them, the 80-year-old woman asked the Garda were they operating under their oath of office. When they avoided this question, she kindly informed them that her home was inviolable save in accordance with the law, and asked them what law she had broken. The Garda left temporarily.

Ben and People for Economic Justice, have now barricaded themselves in the house, and are awaiting the arrival of the Sheriff, so that they can inform him of the same thing!

Follow Up From The 80 Year Old Woman’s Apartment

As you can see from the second video. The Gardai upheld their oath, taken under the constitution, and left Ben and People For Economic Justice to their business. What is most important about this video is that while Ben engages the Gardai, he speaks passively at all times, informing that Gardai that he has taken the actions he chose to take, as he was concerned about someone referring to themselves as The Sheriff wanted to take the property from the 80-year-old woman.

Man Falsely Arrested While Pat Rabbitte Looks On

Follow on from our visit to Savills earlier in the day, Ben Gilroy, People For Economic Justice, TNS Radio, and assorted citizens decided to go down the road to Buswells Hotel for a cup of tea and a chat. Shortly after arriving they noticed Minister For Communication Pat Rabbitte was in the corner having what appeared to be an executive lunch with an unknown gentleman. For the most part they went undisturbed, until one person approached the minister and voiced his opinions on the actions of the current Fine Gael/Labour coalition government.

John Rogers Arrested, Pat Rabbitte Pours More Tea

The events of the day do not end there however! The man was asked to leave, or the hotel management would call An Garda Síochána. The man then did so, but it soon transpired that the hotel management had opted to call An Garda Síochána regardless. On arrival, the Gardai asked where the man was, and the hotel manager pointed out John Rogers.

Throughout the unknown mans encounter with Minster Rabbitte, John had remained fairly removed from the incident, and yet is now pointed out as the man who interrupted the ministers lunch. The Gardai approached John and asked him to leave. John asked why he should do so, as he was not involved in the incident. As the next video will show, John was then forcibly removed, by the Gardai who outright refused to answer any questions on the topic. Indeed, so intent where they to remove this completely innocent man, that they forced him to the floor before escorting him out the door, and on to Store Street Garda Station. John remained there for four hours, before being realised without charge.

This is where People For Economic Justice take issue with the matter. Pat Rabbitte was completely and totally aware that John Rogers was not the man who had approached him during his lunch. It was obvious to everyone, including Par Rabbitte’s lunch guest, that they were two totally different men. Why exactly did this Minister For Communication fail to communicate this to the Gardai? It would have been a matter of raising his hand to draw in the attention of either of the Gardai, and uttering the simple words “That isn’t the man who approached me”.
